1. INTRODUCTION
These Subscription Terms ("Terms") supplement and form part of the Peaksters Terms of Service and govern all paid subscription services provided by Peaksters ("Company," "we," or "us") to users of the Peaksters application ("Service"). These Terms apply to all subscriptions to our Service, whether monthly, annual, or other billing cycle.
Parent/Guardian Responsibility: Since Peaksters is designed for children ages 6-14, the parent, guardian, or adult account holder ("Subscriber") is the party entering into these Terms and is responsible for all subscription charges, use of the Service, and compliance with these Terms.
By subscribing to a paid plan, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.
2. SUBSCRIPTION PLANS
2.1 Available Plans
Peaksters offers the following subscription tiers (pricing and features subject to change):
Free Tier: Limited access to basic motion analysis features, community challenges, and progress tracking.
Monthly Subscription: Full access to all features, including advanced AI-powered motion analysis, personalized coaching, offline downloads, and ad-free experience. Price displayed in the App Store / Google Play at the time of purchase.
Annual Subscription: Full access to all features with annual billing, typically offering better value than monthly plans. Auto-renews annually. Price displayed in the App Store / Google Play at the time of purchase.
2.2 Regional Variations
Subscription pricing and plan availability may vary by region, currency, and applicable local taxes. We will display the price in your local currency at the time of purchase through the respective app store.
3. PAYMENT PROCESSING
3.1 Payment Method
All subscription payments for Peaksters are processed exclusively through the Apple App Store or Google Play Store. Payment is charged to the payment method associated with your app store account.
3.2 No Direct Payment Processing
Peaksters does not collect, process, store, or have access to your payment card information, billing address, or other sensitive financial data. All payment processing is handled securely by Apple and Google respectively. Peaksters receives only confirmation of successful transactions.
3.3 App Store Terms Govern
Your subscription is subject to the terms, conditions, and privacy policies of the Apple App Store or Google Play Store, as applicable. By subscribing, you agree to comply with the respective app store's terms. In the event of any conflict between these Terms and the app store's terms, the app store's terms shall prevail with respect to payment processing.
3.4 Taxes and Fees
The subscription price displayed does not include applicable sales tax, VAT, GST, or other transaction taxes, unless explicitly stated. Such taxes will be calculated and added by the app store at the point of purchase. The total amount charged will appear in your app store billing statement.
4. FREE TRIAL
4.1 Trial Eligibility
Peaksters may offer a free trial period (typically 7 or 14 days, as specified at the time of signup) to new subscribers or returning users. Each user or device is eligible for one free trial. Trial eligibility is determined by Peaksters in its sole discretion and verified at signup.
4.2 Trial Period Features
During the free trial, you will have full access to all premium features at no cost. Your trial will be clearly marked in your account settings, including the end date.
4.3 Automatic Conversion
At the end of your free trial period, your subscription will automatically convert to a paid subscription at the applicable rate. You will be charged within 24 hours of the trial end date unless you cancel before the trial expires. The app store will send you a confirmation and charge notification.
4.4 Cancelling Before Trial Ends
To avoid being charged, you must cancel your free trial at least 24 hours before it expires. See Section 6 for cancellation instructions. Cancelling the trial will immediately revoke access to premium features, and your account will revert to the free tier.
5. AUTO-RENEWAL
5.1 Automatic Renewal
Your subscription is set to auto-renew at the end of each billing period (monthly, annual, or other). Unless you cancel prior to the renewal date, your subscription will automatically renew, and your payment method will be charged for the next billing cycle.
5.2 Renewal Price and Terms
Your subscription will renew at the same price as the current billing period unless Peaksters provides notice of a price change (see Section 8). You will be notified of any price changes at least 30 days in advance.
5.3 Renewal Timing
Your subscription will be charged within 24 hours before the end of your current billing period. The exact time may vary depending on your app store settings and account configuration. The app store will send a notification confirming the renewal charge.
5.4 Checking Renewal Date
You can view your subscription renewal date and status in your app store account settings or within the Peaksters app under Subscription Settings.
6. CANCELLATION
6.1 Right to Cancel
You have the right to cancel your subscription at any time. Cancellation must take place at least 24 hours before your renewal date to avoid being charged for the next billing period.
6.2 Cancelling on Apple App Store (iOS)
To cancel your Peaksters subscription on iOS:
1. Open the App Store app on your iPhone or iPad.
2. Tap the account icon in the bottom right corner (your profile picture or initials).
3. Select "Subscriptions" from the menu.
4. Find "Peaksters" in the list.
5. Tap "Manage" or the subscription and select "Cancel Subscription".
6. Confirm the cancellation. Your subscription will remain active until the end of the current billing period.
6.3 Cancelling on Google Play (Android)
To cancel your Peaksters subscription on Android:
1. Open the Google Play app.
2. Tap your profile icon in the top right corner.
3. Select "Manage subscriptions" or "Subscriptions".
4. Find "Peaksters" in the list.
5. Tap the subscription and select "Cancel subscription".
6. Follow the prompts to confirm cancellation. Your access will continue until the end of the current billing period.
6.4 Deleting the App Does Not Cancel
Important: Deleting the Peaksters app from your device will NOT automatically cancel your subscription. You must follow the steps above through your app store to cancel. Failing to cancel will result in continued charges.
6.5 Access After Cancellation
Upon cancellation, you will retain access to all paid features until the end of your current billing period. After that date, your account will revert to the free tier with limited functionality. No refund will be issued for the current billing period.
7. REFUND POLICY
7.1 App Store Refund Policies
Refunds for subscription purchases are governed by the respective app store's refund policy:
Apple App Store: Apple typically allows refund requests within 45 days of purchase. Refund requests must be submitted through the App Store. Peaksters does not directly process Apple refunds.
Google Play Store: Google typically allows refund requests within 48 hours of purchase. Refund requests must be submitted through Google Play. Peaksters does not directly process Google refunds.
7.2 No Guaranteed Results
The subscription provides access to the Peaksters platform and features. Peaksters does not guarantee specific fitness outcomes, performance improvements, or injury prevention. Results vary based on individual effort, age, fitness level, and commitment. Subscriptions are non-refundable based on lack of desired results.
7.3 EU and UK Cooling-Off Period
Consumers in the European Union and United Kingdom have the right to a 14-day cooling-off period under the Consumer Rights Directive (EU) 2011/83/EU and the Consumer Contracts Regulations 2013 (UK).
Exercising Cooling-Off Right: If you wish to exercise your cooling-off right within 14 days of purchase, contact Peaksters at hello@peaksters.pro with proof of purchase from your app store. Peaksters will assist you in coordinating a refund through the respective app store. This right is subject to local consumer protection laws.
7.4 US Refund Policy
For US subscribers, refunds are governed by the applicable app store policy and state consumer protection laws, including California's Automatic Renewal Law (Cal. Bus. & Prof. Code § 17602) and similar laws in other states. You may be eligible for a refund if you cancel within the app store's standard window and comply with applicable state law requirements.
7.5 Technical Issues
If you experience technical issues preventing access to your subscription (e.g., app crashes, feature unavailability due to server errors), please contact hello@peaksters.pro with details. Peaksters may, at its sole discretion, issue a refund, credit, or service extension for documented technical failures.
8. PRICE CHANGES
8.1 Right to Change Price
Peaksters reserves the right to change subscription prices at any time. Price changes apply only to renewals after the change date, not to the current billing period.
8.2 Notice of Price Changes
Peaksters will provide at least 30 days' written notice of any price increase. Notice will be sent via email and/or displayed in-app. If you do not accept the new price, you may cancel your subscription before the price change takes effect.
8.3 Continued Use = Acceptance
If you do not cancel within the 30-day notice period, your subscription will renew at the new price. Continued use of the Service after the price change date constitutes your acceptance of the new price.
9. SUBSCRIPTION MODIFICATIONS
9.1 Upgrading and Downgrading
You may upgrade or downgrade your subscription plan at any time through your app store account settings or within the Peaksters app.
9.2 Proration
If you change plans mid-billing cycle, charges or credits will be prorated based on the remaining days in your current period. Proration is handled automatically by the app store. Any credits will be applied to your next billing period.
9.3 Feature Changes
Peaksters may modify, add, or remove features from subscription plans. Substantial changes will be communicated in advance. If you do not accept changes to your plan, you may cancel within 30 days of the change notification.
10. SERVICE AVAILABILITY
10.1 No Guarantee of Uninterrupted Service
While Peaksters strives to maintain reliable service, we do not guarantee that the Service will be uninterrupted, error-free, or available at all times. The Service may be unavailable due to maintenance, updates, technical issues, or factors beyond our control.
10.2 Planned Maintenance
Peaksters may perform scheduled maintenance that temporarily interrupts service. We will endeavor to provide advance notice of planned maintenance windows and will schedule them at times of lower usage when possible.
10.3 Force Majeure
Peaksters is not liable for service disruptions caused by force majeure events beyond our reasonable control, including natural disasters, wars, pandemics, government actions, internet outages, or acts of third parties. During such events, subscription fees may not be prorated or refunded.
11. SUSPENSION AND TERMINATION
11.1 Right to Suspend or Terminate
Peaksters reserves the right to suspend or terminate your subscription and account access if you:
• Violate these Terms or the Peaksters Terms of Service;
• Engage in harassment, abuse, or harmful behavior toward other users;
• Attempt to hack, reverse-engineer, or gain unauthorized access to the Service;
• Repeatedly violate app store policies or content guidelines;
• Have multiple failed payment attempts or engage in fraudulent billing.
11.2 Effect on Subscription
Upon suspension or termination, your subscription access is immediately revoked. You will not be able to access premium features, and any accumulated progress or data may be forfeited.
11.3 No Refund for Termination Due to Violation
If your subscription is terminated due to a breach of these Terms, you will not receive a refund of any remaining subscription fees, except as required by applicable consumer protection laws (particularly EU/UK regulations). You may still be entitled to a cooling-off period or refund under mandatory consumer law.
11.4 Right to Appeal
If you believe your subscription was suspended or terminated in error, contact hello@peaksters.pro within 30 days with supporting information. Peaksters will review and respond to your appeal.
12. NO PERFORMANCE GUARANTEES
12.1 Access, Not Medical Product
Your subscription provides access to the Peaksters platform and its features. Peaksters is an educational fitness application and is NOT a medical device, clinical tool, or substitute for professional medical advice, diagnosis, or treatment.
12.2 No Guaranteed Fitness Results
Peaksters does not guarantee any specific fitness outcomes, performance improvements, weight loss, strength gains, or other physical results. Results depend on individual factors including age, baseline fitness, effort, consistency, nutrition, and genetics.
12.3 No Injury Prevention Guarantee
While Peaksters uses AI motion analysis to provide feedback, we do not guarantee injury prevention. Peaksters is not a substitute for proper coaching, medical clearance before exercise, or injury treatment. Always consult a medical professional before starting a new fitness program.
12.4 Not a Substitute for Professional Training
Peaksters is designed for educational and recreational fitness use. It is not a substitute for guidance from a certified fitness trainer, physical therapist, or medical doctor. For serious athletic training or recovery from injury, consult a qualified professional.
13. FUTURE PAYMENT METHODS
13.1 Future Website and Direct Payment Options
Currently, all subscriptions are processed through the Apple App Store or Google Play Store. As Peaksters grows, we may introduce additional payment options, including website-based subscriptions and direct billing. These future payment methods will be subject to updated Terms and Privacy Policy.
13.2 Additional Consumer Protections
If Peaksters implements direct payment methods, additional consumer protections may apply, including:
• Enhanced data security and PCI DSS compliance;
• Clear billing descriptors on credit card statements;
• Explicit consent before charging;
• Easy cancellation mechanisms compliant with ROSCA and other regulations.
13.3 Transition to New Payment Methods
If you are transitioned to a new payment method, Peaksters will provide advance notice and allow you to opt-in with full transparency. Your rights under these Terms and applicable consumer law will remain in effect.
14. JURISDICTION-SPECIFIC PROVISIONS
14.1 United States
ROSCA Compliance: Peaksters complies with the U.S. Restore Online Shoppers Confidence Act (ROSCA, 15 U.S.C. § 7701). Subscriptions are processed through the Apple App Store and Google Play Store, both of which obtain explicit, affirmative consent before charging and provide clear terms.
State Auto-Renewal Laws: Peaksters complies with state auto-renewal laws, particularly:
• California (Cal. Bus. & Prof. Code §§ 17602-17606): Clear terms before charging, simple cancellation mechanism, regular billing notifications.
• New York (GBL § 527): Clear, conspicuous terms; free trial terms must be clearly disclosed.
• Other states: Peaksters complies with similar auto-renewal laws in all 50 states.
Data Deletion: For US users requesting account deletion, Peaksters will comply with applicable state privacy laws, including California Consumer Privacy Act (CCPA) and Virginia Consumer Data Protection Act (VCDPA).
14.2 United Kingdom
Consumer Contracts Regulations 2013: UK consumers have a 14-day cooling-off period from the date of purchase, except where digital content delivery has begun with consent and acknowledgment of loss of withdrawal right (see Section 7.3).
Consumer Rights Act 2015: Services must be provided with reasonable care and skill, within a reasonable time, and at a reasonable price. Peaksters warrants that the Service will be provided in accordance with these standards.
Payment Security: For any future direct payment methods in the UK, Peaksters will comply with the Payment Services Regulations 2017 and maintain PCI DSS compliance.
14.3 European Union
Consumer Rights Directive (2011/83/EU): EU consumers have a 14-day withdrawal period from the date of purchase, except where digital content delivery has begun with express consent (see Section 7.3).
Digital Content Directive (2019/770): Digital services must conform to the contract and be supplied with reasonable care and skill. Peaksters warrants compliance with these standards.
GDPR Compliance: Peaksters processes personal data of EU users in compliance with the General Data Protection Regulation (GDPR). See our Privacy Policy for details on data processing, rights, and legitimate interests.
Payment Services Directive 2 (PSD2): For any future direct payment methods in the EU, Peaksters will comply with PSD2 requirements, including strong customer authentication and open banking standards.
14.4 Conflicting Laws
If any provision of these Terms conflicts with mandatory consumer protection laws in your jurisdiction, the mandatory law shall prevail. Peaksters will comply with the strongest consumer protection standard applicable to you.

GENERAL PROVISIONS
Entire Agreement: These Subscription Terms, together with the Peaksters Terms of Service and Privacy Policy, constitute the entire agreement regarding your subscription. Any prior agreements or understandings are superseded.
Modifications: Peaksters may modify these Terms at any time. Continued use of the Service following notice of changes constitutes acceptance. Material changes will include 30 days' notice.
Severability: If any provision is found invalid, the remaining provisions remain in effect.
Waiver: Failure to enforce any provision does not waive the right to enforce it later.
Governing Law: These Terms are governed by applicable local laws in your jurisdiction, with particular regard to consumer protection laws in the US, UK, and EU.
